Welcome to Industry Ignitors.
Industry Ignitors is a brand of Industry Ignitors Publishing, LLC (“Industry Ignitors,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of industryignitors.com (the “Site”), including our contact forms, Website Review request, chat features, sample website concepts, and other information or services made available through the Site. Section 5 also describes our standard managed website service terms, which apply to a paid engagement when incorporated into or accepted through the applicable written client agreement.
By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. Purpose of the Site
Industry Ignitors provides website design, website management, consulting, website evaluation, digital strategy, content-related services, and related services primarily for businesses in the United States.
The Site is intended to provide information about our services, allow prospective clients to contact us, request a Website Review, view examples of our work and concepts, and begin discussions about potential projects.
Information on the Site is provided for general informational and business purposes and does not, by itself, create a client relationship.
2. Website Reviews
Industry Ignitors may offer complimentary or paid website evaluations, reviews, audits, or similar assessments.
A Website Review is intended to provide practical observations and recommendations based on the information reasonably available at the time of the review.
Website Reviews may consider matters such as design, usability, messaging, customer experience, search visibility, mobile presentation, technical implementation, website structure, and other factors we consider relevant.
A Website Review is not a guarantee of improved traffic, search-engine rankings, leads, sales, revenue, or other business results.
The Internet, search engines, browsers, devices, advertising systems, third-party platforms, and business conditions change frequently. Findings and recommendations are therefore based on conditions observed at the time of the review.
3. AI-Assisted Work
Industry Ignitors may use artificial intelligence tools to assist with portions of website evaluation, research, planning, content development, design ideation, coding, troubleshooting, and other website-related work.
AI-assisted tools may be provided with information reasonably relevant to the requested work, including website URLs, publicly available website content, screenshots, mockups, documents, or other materials you provide for evaluation or use in a project.
AI tools assist our work but do not replace human judgment. Industry Ignitors may review, modify, reject, verify, or further develop AI-assisted output before incorporating it into our work.
AI-generated or AI-assisted material can contain errors, omissions, or unexpected results. No representation is made that AI-assisted material will always be complete, accurate, original, or suitable for every purpose.
Our handling of information used with AI tools is further described in our Privacy Policy.
4. Information and Materials You Provide
You may provide us with information, text, images, photographs, logos, designs, screenshots, documents, mockups, website credentials, business information, or other materials in connection with an inquiry, Website Review, or project.
By providing materials to Industry Ignitors, you represent that you have the right to provide those materials and to allow us to use them for the purpose for which they were submitted.
You should not provide confidential, sensitive, copyrighted, personally identifiable, or proprietary material belonging to another person or organization unless you are authorized to do so.
You retain ownership of materials that you own.
You grant Industry Ignitors permission to access, reproduce, analyze, transform, and otherwise use submitted materials as reasonably necessary to respond to your inquiry, prepare a Website Review, evaluate a potential project, or provide agreed services.
Contact information submitted through the Site may also be used for newsletters and marketing communications as described in our Privacy Policy and subject to applicable law and your right to unsubscribe.
5. Client Projects and Managed Website Services
Submitting a form, requesting a Website Review, communicating through chat, or discussing a potential project does not obligate either party to enter into a paid engagement.
Paid services are described in an accepted proposal, statement of work, service agreement, or other written client agreement. That agreement identifies the project scope, setup investment, selected monthly package, payment schedule, deliverables, and any project-specific terms.
The following provisions describe our standard managed website arrangement. If a separate written client agreement conflicts with these Terms regarding a paid engagement, that agreement controls for that engagement. Posting or updating these Terms does not, by itself, amend an existing client agreement.
5.1. Customer Ownership and Licensed Materials
You retain ownership of the business content, brand materials, and other materials you own and provide to us. Your business is the intended registered holder of its domain name, with Industry Ignitors authorized to administer the registration, renewal, DNS, and related settings as part of the agreed services.
Once the initial website build is completed and launched and the setup investment is paid in full, you own the finished customer-specific website and custom design, content, and code created for your project, to the extent those rights are owned by Industry Ignitors and can be transferred. Any applicable assignment of copyright will be documented in a signed client agreement.
Customer ownership does not include Industry Ignitors’ brand, internal systems, agency accounts, credentials, pre-existing materials, or reusable tools and components. To the extent our reusable materials are incorporated into your completed website, we grant you a continuing, nonexclusive license to use and modify those materials as part of that website, including after the managed service ends.
WordPress, themes, plugins, stock assets, fonts, APIs, and other third-party products remain subject to their applicable licenses and provider terms. Some may require replacement licenses or accounts when your website moves to another provider. Agency subscriptions and nontransferable licenses are not transferred to you.
5.2. Administrative Access and Managed Control
While your managed website plan is active, Industry Ignitors retains exclusive administrative access to the website backend and the hosting and technical systems we manage. We handle security, software updates, maintenance, and technical configuration. Customers do not receive WordPress administrator access or access to our agency hosting and service accounts during this arrangement.
You request website changes through Industry Ignitors. Included changes and support are determined by your selected package and client agreement. This managed-access arrangement does not change your ownership rights or prevent an authorized handoff when the service ends.
5.3. Monthly Services and Included Expenses
The monthly plan is separate from the initial setup investment. It covers website hosting, security, software updates, maintenance, technical administration, and the support and tools included in your selected package. Domain registration, renewal, and other services are included to the extent stated in your proposal or client agreement.
Content changes, performance reviews, integrations, and other ongoing services vary by package. We do not promise unlimited revisions, support, storage, third-party usage, or additional features unless expressly included in your client agreement.
Premium tools, additional subscriptions, usage-based fees, advertising, and work outside the included scope may involve additional charges. Applicable charges will be identified and approved before they are incurred.
5.4. Cancellation and Notice
After the initial website build is completed and launched and the setup investment is paid in full, you may cancel your ongoing managed website plan with at least 30 days’ written notice, unless your written client agreement expressly provides otherwise.
Send cancellation notice to admin@industryignitors.com from an authorized business representative. The notice period begins when we receive the written notice. We will confirm the service end date and explain the handoff process.
Service and applicable charges continue through the notice period. Your client agreement will specify billing dates, the calculation of final charges, and any applicable proration or refund terms. Cancellation does not itself create a right to a refund for completed work or services already provided, except where required by law or agreed in writing.
Cancellation does not eliminate outstanding payment obligations. Cancellation before the initial build is completed, and termination for nonpayment, breach, or other circumstances, are addressed in the applicable client agreement.
5.5. Website Export and Domain Handoff
Once the initial build is completed and launched and the setup investment is paid in full, a standard handoff includes an export of the transferable website files and database and reasonable cooperation in handing over domain administration to you or your authorized replacement provider. We will make the standard export available during the notice period when you provide the authorization and recipient information needed for a secure handoff.
You or your replacement provider are responsible for arranging new hosting, continued domain renewal, any applicable email services, and replacement software licenses, subscriptions, and API accounts. Provider rules or transfer restrictions may affect the timing or method of a domain transfer.
Our agency account credentials, subscriptions, internal systems, and nontransferable licenses are excluded. Third-party tools may require replacement or reconfiguration, and functionality may differ after the move.
The standard export and domain handoff do not include installing the website on a new host, rebuilding features, repairing another provider’s configuration, or replacing licensed tools. Additional migration, setup, or development work can be quoted separately.
Ending website hosting does not authorize us to cancel, delete, or surrender your domain registration solely because the managed website plan has ended. You remain responsible for arranging ongoing domain administration and renewal after the handoff.
5.6. Hosting End Date, Recovery Copy, and Deletion
Hosting and managed services end on the confirmed service end date unless a paid extension is agreed in writing. The service does not continue automatically because a migration remains incomplete. The website may become unavailable when hosting ends.
We retain a recovery copy of the hosted website files and database for an additional 30 days after the service end date. During that period, you may request the standard export. Retaining this copy does not include continued live hosting or additional migration work.
After the additional recovery period, we delete the hosted website and recovery copy from active storage, unless a written extension or applicable preservation obligation requires otherwise. Once those copies are deleted, we do not promise that the website can be recovered.
Deletion from active storage does not mean simultaneous removal from every routine backup or third-party system. Residual copies may remain until they are overwritten or removed through the applicable backup or provider processes. We will describe the applicable backup-retention arrangements in your client agreement. Residual backup copies are not an extension of the recovery service and are not guaranteed to be available for restoration.
Ending the service or deleting a hosted website does not require deletion of appropriate business records, such as agreements, invoices, payment history, communications, and limited documentation of work performed. Those records are handled under our Privacy Policy and applicable law. Retaining business records does not mean maintaining a recoverable copy of your website indefinitely.
5.7. Information Hosted for Clients
Providing hosting and maintenance may require us and our service providers to process website content, databases, form submissions, logs, credentials, and backups on your behalf. You are responsible for the business purposes for which your website collects information, the accuracy of your website’s privacy disclosures, and any permissions or instructions required for that processing.
We use hosted client information as reasonably necessary to provide the agreed services and follow the applicable client agreement, privacy requirements, and authorized instructions. An export may contain information submitted by your website visitors. We will release it only to you or an appropriately authorized recipient using reasonable security measures.
6. Pricing and Service Information
We make reasonable efforts to keep pricing, service descriptions, features, and other information on the Site accurate and current.
However, pricing, packages, features, availability, and service terms may change.
Information displayed on the Site does not constitute a binding offer unless expressly stated otherwise. Final scope and pricing for a project may depend on the client's needs and will be confirmed through the applicable proposal or agreement.
Industry Ignitors reserves the right to correct errors, omissions, or outdated information on the Site.
7. No Guarantee of Business Results
Websites and digital marketing tools can support a business, but many factors affecting business performance are outside our control.
Industry Ignitors does not guarantee any particular level of website traffic, search-engine ranking, leads, conversion rate, customer inquiries, revenue, profitability, advertising performance, or other business result.
Any examples, illustrations, projections, recommendations, or discussions of potential results are intended to demonstrate possibilities and should not be interpreted as guarantees.
8. Sample Websites and Concept Designs
The Site may display fictional website concepts, sample designs, demonstrations, mockups, or other illustrative materials.
These examples are intended to demonstrate design possibilities, strategy, layout, messaging, functionality, or creative direction. Unless expressly identified otherwise, they should not be interpreted as representations of completed client projects.
Sample concepts are examples, not pre-made templates that clients are required to select from. Actual client websites may be custom designed around the client's business, audience, goals, content, branding, and functional requirements.
Business names, testimonials, people, statistics, addresses, services, or other details appearing within fictional concepts may be created solely for demonstration purposes.
9. Industry Ignitors Intellectual Property
Unless otherwise stated, the Site and its original content, design, graphics, text, branding, logos, layouts, concepts, code, downloadable materials, and other elements are owned by or licensed to Industry Ignitors Publishing, LLC and are protected by applicable intellectual-property laws.
You may view and use the Site for legitimate personal or business informational purposes.
You may not reproduce, republish, distribute, sell, license, scrape, copy, modify, create derivative works from, or commercially exploit substantial portions of the Site or our original materials without prior written permission.
Except for customer-specific website ownership and licenses expressly described in Section 5 or a separate written client agreement, these Terms do not transfer ownership of Industry Ignitors intellectual property. The restrictions in this section concern the Site and our own materials; they do not prevent a customer from using or transferring their completed website under the applicable client agreement.
10. Acceptable Use
You agree not to use the Site to violate any applicable law; interfere with or disrupt the operation or security of the Site; attempt to gain unauthorized access to our systems or other accounts; submit malicious code, spam, fraudulent information, or automated submissions; impersonate another person or organization; collect information from the Site through unauthorized automated means; misuse contact forms, chat functions, or Website Review requests; or use Industry Ignitors materials in a way that infringes our rights or the rights of others.
We may restrict or block access to the Site when we reasonably believe it is being misused.
11. Third-Party Services
The Site and our managed website services rely on third-party products and services for various functions.
These may include website hosting, WordPress software and plugins, form processing, analytics, customer relationship management, chat functionality, email, security and spam prevention, artificial intelligence services, and other technical services.
These services may be governed by separate terms and privacy policies maintained by their respective providers.
Industry Ignitors does not control every aspect of third-party services and cannot guarantee their continuous availability, security, compatibility, or performance.
12. Third-Party Websites and Links
The Site may contain links to websites, platforms, tools, or resources operated by third parties.
Links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.
Industry Ignitors is not responsible for the content, availability, security, accuracy, products, services, or privacy practices of third-party websites.
Your use of a third-party website or service is subject to that provider's terms.
13. Website Availability
We make reasonable efforts to maintain the Site, but we do not guarantee uninterrupted or error-free operation.
The Site may occasionally be unavailable because of maintenance, hosting issues, security measures, software updates, third-party outages, technical failures, or circumstances outside our control.
We may modify, suspend, discontinue, replace, or update any part of the Site without notice.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and information provided through the Site are offered on an “as is” and “as available” basis.
Industry Ignitors makes no warranty that the Site will be uninterrupted, error-free, completely secure, or free from harmful components, or that information made available through the Site will always be accurate, complete, current, or suitable for a particular purpose.
Any warranties applicable to paid client services will be governed by the applicable client agreement.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Industry Ignitors Publishing, LLC and its owners, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Site.
This includes, without limitation, loss of profits, revenue, data, business opportunity, goodwill, or anticipated savings.
Where liability cannot legally be excluded, liability relating solely to use of this Site will be limited to the maximum extent permitted by applicable law.
Liability arising from paid professional services may be governed separately by the applicable client agreement.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Industry Ignitors Publishing, LLC and its owners, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable expenses arising from your misuse of the Site, your violation of these Terms, your violation of another person's rights, or materials you provide without appropriate authorization.
17. Privacy
Your use of the Site is also subject to our Privacy Policy, which explains how we collect, use, retain, store, and disclose information and describes certain choices that may be available regarding personal information.
The Privacy Policy is incorporated into these Terms by reference. Our retention of personal information and business records is described in that policy. The hosting end date, website export, recovery-copy period, and active-storage deletion for a managed client website are addressed in Section 5 and the applicable client agreement. Those provisions concern specific hosted website copies and do not impose a general retention deadline on all business records.
18. Electronic Communications and Marketing
When you submit a form, request a Website Review, communicate with us through chat, send us an email, or otherwise provide your contact information, you consent to receiving electronic communications reasonably related to your inquiry, requested service, Website Review, project, or business relationship.
Industry Ignitors may also send newsletters, website tips, company updates, information about our services, promotional offers, and other marketing communications where permitted by applicable law.
Marketing communications are optional. You may unsubscribe from marketing emails at any time using the unsubscribe link contained in those messages or by contacting admin@industryignitors.com.
Unsubscribing from marketing messages does not prevent Industry Ignitors from sending communications that are necessary or appropriate in connection with an inquiry, existing project, client relationship, requested service, legal notice, or administrative matter.
Where applicable law requires affirmative consent before marketing communications may be sent, Industry Ignitors will seek such consent before sending those communications.
Your marketing preferences and our use of your contact information are further described in our Privacy Policy.
19. Termination or Restriction of Access to the Site
We reserve the right to restrict, suspend, or terminate access to the Site or particular Site features when reasonably necessary to protect the Site, our business, our clients, our service providers, or other users. This provision concerns access to industryignitors.com. Cancellation, transfer, and termination of a paid managed website service are addressed separately in Section 5 and the applicable client agreement.
20. Governing Law
These Terms will be governed by and interpreted under the laws of the State of Wisconsin, without regard to conflict-of-law principles.
Any dispute that is not governed by a separate written client agreement will be brought in a court of competent jurisdiction located in Wisconsin, unless applicable law requires otherwise.
21. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
22. No Waiver
Failure by Industry Ignitors to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
23. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, technology, business practices, or legal requirements.
When changes are made, the “Last Updated” date at the top of this page will be revised.
Your continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Updates posted on the Site do not, by themselves, change an existing signed client agreement or previously granted ownership rights. Changes to an existing paid engagement must follow the amendment process in the applicable client agreement.
